DWI Accidents Resulting in Injury or Death

DWI’s get more serious if there are accidents, injuries, or deaths involved:

A driver is charged with a class E felony in Missouri if they were driving under the influence of drugs or alcohol and got in an accident which resulted in any physical injury to another person. This offense could mean up to 4 years in prison and up to $10,000 in fines.

A driver is charged with a class D felony in Missouri if they were driving under the influence of drugs or alcohol and got in an accident which resulted in serious physical injury to another person. This offense could mean up to 7 years in prison and up to $10,000 in fines.

A driver is charged with a class C felony in Missouri if they were driving under the influence of drugs or alcohol and got in an accident which resulted in (1) death of any person or (2) injury of a law enforcement or emergency personnel. This offense could mean 3-10 years in prison and up to $10,000 in fines.

A driver is charged with a class B felony in Missouri if they were driving under the influence of drugs or alcohol and got in an accident which resulted in the death of a law enforcement officer or emergency personnel.  This offense could mean 5-15 years in prison.

A driver may be charged with a class A felony in Missouri if they were driving under the influence of drugs or alcohol and have previously been found guilty of a class B felony DWI. This offense carries from 10-30 years in prison.
