Administrative License Hearing
Almost all driving while intoxicated cases involve a criminal case and a civil license case. If you are arrested on suspicion of driving while intoxicated, and you provide a chemical test of .08% blood alcohol content or above, you will face an administrative license suspension. This process begins with the officer seizing your Missouri license (not allowed to seize an out of state license) and providing you with a Form 2385. The Form 2385 will act as your temporary driving privilege. An administrative license hearing must be requested within 15 days of your arrest.
It is imperative you hire an experienced DWI attorney like me to handle your administrative hearing. The average attorney wins less than 4% of his/her administrative license hearings. In 2016, I won over 90% of my hearings. If you do not appeal within 15 days, or the hearing is lost, you will lose your license for 90 days, if you have gone 5 years or more without an alcohol related enforcement contact ("AREC"), or 1 year, if you have an AREC within the previous 5 years.
